COMPANY BACKGROUND

SMART Performance began in 1998 with the need to fine tune and resolve suspension and chassis issues
associated with large displacement road racing motorcycles. Since that time, just about everything with two wheels
and a suspension has gone “under the microscope” for analysis and the prospects of engineering and building
designs that offer faster and more manageable rides.

Since 2003, the main focus of SMART Performance has been the off-road motorcycle with emphasis on the needs
for the dedicated novice to professional level of riders in the sport of Supercross, Motocross, Woods and Freestyle.
The goal and primary objective of SMART Performance is simple - level the playing field by delivering technologies
that offer the most optimal performance and safest ride for the best price.

SMART Performance’s main office is located in Los Gatos, California with engineering, machining and manufacturing performed at various U.S. locations.


OBJECTIVES AND GOALS

The SMART Performance goal is simple - do everything that we can to make a dirt bike safer, faster and more comfortable to the rider.

To do this, we will be selling products that we truly believe make a difference. Some of these products will be devices or services that are unique to SMART Performance, and other products and services will be from companies that we have tested and verified.

Some of the SMART Performance products will be sold directly to riders and DIY tuners, and others will be sold to professional tuners and suspension engineers.

In addition to this, SMART Performance wants to be a key link between the success of the rider and the suspension industry. This is why we volunteer a significant amount of our time in consulting riders about how to work with their existing suspension to resolve problems, how to find and work with the right tuner, and to help professional tuners find better ways to resolve complex issues.

GUARANTEES  AND WARRANTIES

If any SMART Performance product or service does not meet the expectation of the customer, for
any reason, or if the product fails in anyway, we buy it back, replace it or if the customer chooses, we will resolve the
matter until satisfaction is achieved.

The main reason we make this claim is that we want to fully support or own belief that we are producing and selling
the best and highest performing products available. If we are not, then the customer should have the liberty to be
the first ones to tell us so without the obligation associated against their bank account.

Additionally, the more riders and mechanics that feed information back to us, be it good or bad, the more we learn –
and that’s priceless. We can’t duplicate all experiences in our lab (although we are working on it) and therefore
want to assure that any customer that has not received what we promised, has the right to be treated like a top
factory rider.


SHIPPING AND SERVICE POLICIES

We will make every effort to ship orders as soon as possible and will also strive to house as much inventory as our
facilities can hold to insure that we get what the customer needs in the shortest amount of time. Custom services, such as re-valves and engineering work, should be scheduled with us beforehand so that we
can begin work as soon as the items arrive.

All items will be shipped in proper containers with the safest and most appropriate carrier based on contents and
final destination.

SMART Performance ships worldwide using the best carrier based on our experience, or we can use the carrier of
your choice.
